Gift Card Terms & Conditions

These terms and conditions ("Gift Card Terms") tell you the legal terms and conditions, which apply to the purchase and use of physical Hamilton & Inches Gift Cards ("Gift Cards").

These Gift Card Terms apply to pounds sterling Gift Cards purchased online through Hamilton & Inches’ website www.hamiltonandinches.com as well as Gift Cards purchased physically at Hamilton & Inches’ Showroom.

Please read these Gift Card Terms carefully before purchase to ensure that you understand how Gift Cards work and that you are familiar with any restrictions which may apply to their use.

These Gift Card Terms may be amended from time to time. Whenever you purchase Gift Cards, please check these Gift Card Terms to ensure you understand the terms and conditions, which will apply at that time.

1. Showroom Purchases

1.1 You may purchase physical Gift Cards at Hamilton & Inches’ showroom.

1.2 When you purchase a Gift Card at Hamilton & Inches’ showroom, the sale is made to you by Hamilton & Inches Limited, a company registered in Scotland. Our company registration number is SC041917 and our registered office is at 16 Charlotte Square, Edinburgh, EH2 4DF. Our main trading address is 87 George Street, Edinburgh, EH2 3EY. Our registered VAT number is 717 0677 30.

2. Online Purchases

2.1 You may purchase physical Gift Cards online through Hamilton & Inches’ website www.hamiltonandinches.com.

 

2.2 When you purchase a Gift Card online through Hamilton & Inches’ website, the sale is made to you by Hamilton & Inches Limited, a company registered in Scotland. Our company registration number is SC041917 and our registered office is at 16 Charlotte Square, Edinburgh, EH2 4DF. Our main trading address is 87 George Street, Edinburgh, EH2 3EY. Our registered VAT number is 717 0677 30.

 

2.3 After you place an online order for a Gift Card, you will receive an email acknowledging that we have received your order.

 

2.4 We will send you a dispatch confirmation email confirming that your Gift Card has been dispatched. Our contract with you will come into effect at that point.

3. Delivery of Gift Cards

3.1 Physical Gift Cards shall be delivered in accordance with the delivery terms set out in our Terms & Conditions.

 

3.2 You are solely responsible for the accuracy of the information provided by you when you place your order and we have no liability to you or to the intended recipient in the event that your order is delivered to the incorrect address unless the error arises directly from our negligence or our breach of these Gift Card Terms or our Terms and Conditions.

4. Price & Payment

4.1 For physical Gift Cards purchased in our showroom, the minimum amount that can be loaded on the card is £25.

4.2 For physical Gift Cards purchased online through the Hamilton & Inches’s website, the minimum purchase amount is £25.

4.3 The maximum value of gift card(s) that can be purchased online is £1,000.

4.4 The price of Gift Cards includes VAT (where applicable) at the current rates chargeable in the UK for the time being, but excludes delivery costs.

4.5 Delivery charges for physical Gift Cards are as notified to you during the checkout process, before you confirm your order. See our Delivery Information for more details.

4.6 Gift Cards purchased online through the Hamilton & Inches’s website must be paid for using a credit or debit card. Payment for your Gift Cards and all applicable delivery charges is in advance.

4.7 You will own the Gift Cards once payment for the Gift Cards has been received in full, including all applicable delivery charges.

5. Using a Gift Card

5.1 To use a Gift Card in a physical Hamilton & Inches showroom store, bring a copy of the confirmation email Gift Card and or bring your receipt to present it when making your in-store purchase.

5.2 Gift Cards are valid for a period of 24 months starting on the date of purchase (clearly marked on the receipt or confirmation email), following which they expire automatically. A Gift Card cannot be used after the expiry date and any balance remaining upon expiry shall be lost. We have no obligation to remind or inform you of a Gift Card's expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry. Gift Card balances can be checked upon presentation of the Gift Card in our Hamilton & Inches showroom.

5.3 A Gift Card expires automatically once its balance has been exhausted. A Gift Card can be topped up.

5.4 Gift Cards may be used to pay for the whole or any part of an in-store purchase. Any balance which remains due may be paid using any other payment method where you are making your purchase.

5.5 You may use up to three Gift Cards in payment towards any single in-store purchase.

5.6 These Gift Card Terms apply only to pounds sterling Gift Cards purchased from Hamilton & Inches’ website or our showroom.

5.7 Gift Cards may not be used to purchase another Gift Card.

5.8 Gift Cards may not be exchanged for cash. No change will be given when payment is made using a Gift Card and any unused balance will remain on the Gift Card for use in relation to future purchases.

5.9 If you use a Gift Card to purchase goods in our showroom and you subsequently return the goods, any refund due to you will be made in the form of a Gift Card in the case of an online order or a physical Gift Card in the case of showroom purchase.

5.10 Hamilton & Inches reserve the right to refuse to accept a Gift Card as payment if there is reasonable evidence of tampering or fraud.

6. Cancellation & Returns

6.1 Gift Cards may only be returned for a refund in accordance with your legal rights in circumstances where a Gift Card is not as described or is damaged or defective (other than as a result of being mishandled or used improperly by you). If you believe a Gift Card may be damaged, defective or not as described, please contact us on 0131 225 4898 or accounts@hamiltonandinches.com.

6.2 Gift Card purchases made through the Hamilton & Inches’s website may be cancelled at any time prior to dispatch. However, once you have received your dispatch confirmation email, it will be too late to cancel your purchase and prevent your order from being dispatched.

6.3 If you would like to cancel your Gift Card order before you have received your dispatch confirmation email, you must contact 0131 225 4898 or web.team@hamiltonandinches.com Whilst we will attempt to cancel your order prior to dispatch, this may not be possible due to the speed with which orders are processed. If you have notified us of your cancellation prior to receipt of your dispatch confirmation email but we have been unable to prevent dispatch, your recipient has the option of either refusing to accept the delivery, in which case the order will be returned to the Hamilton & Inches, or accepting the delivery and then returning the order to the Hamilton & Inches.

7. Liability to You

7.1 You are solely responsible for the safekeeping and security of your Gift Card following delivery. If you damage, destroy or lose your Gift Card or your Gift Card is stolen or used by someone else (with or without your permission), Hamilton & Inches shall be not liable for any loss or damage you suffer as a result except to the extent that such loss arises from Hamilton & Inches negligence or breach of these Gift Card Terms or the Terms and Conditions, in which event the party at fault shall be solely responsible.

7.2 The full extent of Hamilton & Inches’s liability shall be as set out in the Terms and Conditions and subject to any limitations and exclusions therein.

7.3 For the avoidance of doubt, nothing in these Gift Card Terms limits or excludes Hamilton & Inches liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for defective products under section 2(3) of the Consumer Protection Act 1987 or for any other matter for which it would be illegal for Hamilton & Inches to limit or exclude, or attempt to limit or exclude, liability.

8. Variation

8.1 These Gift Card Terms may be amended from time to time without notice to you. It is your responsibility to check these Gift Card Terms from time to time to ensure you are aware of any changes which may have been made. In the event of changes, the "Last Updated" date at the top of these Gift Card Terms will be updated accordingly.

8.2 Hamilton & Inches reserve the right at any time to cancel any Gift Card and/or suspend or permanently discontinue the Gift Card programme altogether if, in Hamilton & Inches sole discretion, such action is necessary. Such action may be necessary, for example, to make changes to the Gift Card programme, to comply with applicable law or regulation or as a result of circumstances beyond the reasonable control of Hamilton & Inches.

9. Governing Law

9.1 These Gift Card Terms shall be governed by and construed in accordance with the laws of Scotland,. Any dispute or claim arising out of or in connection with these Gift Card Terms (including non-contractual disputes or claims) shall be subject to the jurisdiction of the Scottish courts.
